COCHETICA STORE SALES AND RETURN POLICY

1. GENERAL PROVISIONS

This Sales and Return Policy is drafted in accordance with applicable Romanian legislation, including, but not limited to:

  • Law no. 287/2009 regarding the Civil Code;
  • Government Emergency Ordinance no. 34/2014 regarding consumer rights within contracts concluded with professionals;
  • Law no. 363/2007 regarding combating unfair commercial practices in relation to consumers;
  • Law no. 449/2003 regarding the sale of products and associated guarantees.

By placing an order on the website www.cochetica.com, the client declares that they have read, understood, and accepted the terms and conditions presented in this Sales and Return Policy.

2. TERMS OF SALE

2.1. Products sold on www.cochetica.com are available while stocks last and are offered in accordance with the specifications available on the site.

2.2. Prices displayed on the website are expressed in RON and include VAT according to current legislation. Delivery costs are indicated separately before completing the order.

2.3. By completing the order, the client expresses their agreement regarding the price and characteristics of the products, as presented on the site.

2.4. Cochetica reserves the right to cancel orders in the case of obvious technical or pricing errors, in accordance with the provisions of Article 1665, paragraph (1) of the Civil Code regarding essential error.

3. RETURN CONDITIONS

3.1. In accordance with G.E.O. no. 34/2014, clients have the right to withdraw from the contract, without stating reasons, within 14 calendar days from receiving the products.

3.2. To exercise the right of withdrawal, the client must notify their intention by email to contact.cochetica@gmail.com or by completing the return form.

3.3. Returned products must be in the same condition as received, without signs of use, in their original packaging, accompanied by all accessories and related documents.

3.4. Direct costs of returning the products will be borne by the client, unless the return is due to an error on Cochetica's part or a defective product, in accordance with Article 13, paragraph (3) and Article 14, paragraph (3) of G.E.O. no. 34/2014.

3.5. Reimbursement of paid amounts will be made within 14 days of receiving and verifying the returned products, using the same payment method initially used by the client.

4. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

According to Article 16 of G.E.O. no. 34/2014, products cannot be returned if:

  • they have been unsealed and cannot be returned for health protection or hygiene reasons;
  • they have been made according to the client's specifications or personalized;
  • they are likely to deteriorate or expire rapidly.

5. WARRANTIES AND COMPLAINTS

5.1. Products sold benefit from a warranty in accordance with Law no. 449/2003, the warranty period being specified in the description of each product.

5.2. Any complaint regarding the non-conformity of products can be submitted in writing to the email address contact.cochetica@gmail.com, and Cochetica undertakes to resolve the complaint within 15 working days.

6. FORCE MAJEURE

Cochetica cannot be held responsible for delays or non-performance of its obligations in the case of force majeure events, as defined by current legislation.

7. DISPUTE RESOLUTION

7.1. Any dispute between Cochetica and the client will be resolved amicably, and if this is not possible, jurisdiction rests with the Romanian courts.

7.2. Clients have the possibility to use the alternative dispute resolution (ADR) mechanisms available on the ODR platform (https://ec.europa.eu/consumers/odr).

8. POLICY AMENDMENT

Cochetica reserves the right to modify this Sales and Return Policy without prior notice. Any modification will be published on the website and will take effect from the date of publication.
