Online Store Policy www.cochetica.com

This policy regulates the rights and obligations of the online store www.cochetica.com ("the Store") and its customers ("Users") according to the applicable legislation in Romania. Please read this policy carefully before using the services offered by the Store.

1. Definitions

1.1. The Store – represents the e-commerce platform operated via the website www.cochetica.com, managed by POPA LORENA MARILENA PFA.
1.2. User – any natural or legal person who accesses the website www.cochetica.com and/or places an order. 1.3. Products – goods sold through the Store, available for sale.

2. Legal Framework

This policy is drafted in accordance with Romanian legislation, including, but not limited to:

  • Law no. 365/2002 on electronic commerce, with subsequent amendments and completions;
  • Government Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals;
  • Law no. 193/2000 on unfair terms in contracts concluded between traders and consumers;
  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data ("GDPR").

3. General Conditions

3.1. By using the Store, Users confirm that they agree to this Policy. 3.2. The Store has the right to unilaterally modify this Policy, by notifying Users through the website.

4. Personal Data Protection

4.1. Personal data is processed in accordance with Regulation (EU) 2016/679 ("GDPR"). The complete data processing policy is available at click here! 4.2. Users have the right to request access, rectification or deletion of data, in accordance with Articles 15-17 GDPR.

5. Product Delivery

5.1. The Store delivers products through courier partners, according to the terms specified upon order completion. 5.2. The maximum delivery period is 30 calendar days, in accordance with Article 18 of Government Emergency Ordinance no. 34/2014. 5.3. Delivery costs are clearly displayed before placing the order.

6. Right of Withdrawal

6.1. Users have the right to withdraw from the contract without giving any reason, within 14 calendar days from the receipt of the products, in accordance with Article 9 of Government Emergency Ordinance no. 34/2014. 6.2. Returned products must be in the same condition as they were delivered, without signs of use or damage. 6.3. The direct costs of return are borne by the User, in accordance with Article 14 of Government Emergency Ordinance no. 34/2014.

7. Store's Liability

7.1. The Store guarantees that the products sold comply with the descriptions presented on the website, in accordance with Article 5 of Law no. 365/2002. 7.2. In case of non-conformities, Users may request repair, replacement of the product, or reimbursement of its value, in accordance with Government Ordinance no. 21/1992 on consumer protection.

8. Disputes

8.1. Any disputes will be settled amicably, and if this is not possible, they will be referred to the competent courts of the operator's registered office. 8.2. Consumers can resort to alternative dispute resolution (ADR), in accordance with Regulation (EU) No 524/2013.
