Cochetica Royalty Programme Terms

These terms apply to the Cochetica Royalty loyalty programme available on www.cochetica.com.

Please read these terms carefully before joining or using the programme.

1. Programme Organiser

The Cochetica Royalty loyalty programme is organised by KAPROS LORENA MARILENA PFA, a Romanian authorised sole trader, fiscal code/VAT no. RO41818938, with its registered office at Str. Cișmelei no. 2, Constanța, Romania.

In these terms, KAPROS LORENA MARILENA PFA may also be referred to as “Cochetica”, “we”, “us”, “our” or the Organiser.

2. Eligibility

The Cochetica Royalty programme is available to customers who create a customer account on cochetica.com.

Participation in the programme requires an active customer account and acceptance of these programme terms.

Cochetica reserves the right to refuse, suspend or cancel participation in the programme if we identify abusive, fraudulent or improper use of the programme, or any behaviour that breaches these terms.

3. Earning Points

Points are earned automatically for eligible orders placed on the website, based on the customer’s Royalty level at the time the order is placed.

The points earned for purchases are as follows:

- Bronze: 5 points for every eligible RON 1 spent.

- Silver: 6 points for every eligible RON 1 spent.

- Gold: 7 points for every eligible RON 1 spent.

Points are calculated based on the value of eligible products, excluding VAT, shipping costs and any ineligible amounts, and after any discount codes, promotions or discounts have been applied.

Shipping costs, taxes, refunds, discounts, non-eligible amounts and other charges do not generate points.

If prices are displayed in another currency, the points calculation may be based on the equivalent eligible value according to the technical settings of the loyalty platform and the Store.

Points are awarded when the order is placed, according to the technical settings of the loyalty platform.

4. Cancellations, Refused Orders, Refunds and Returns

If an order is cancelled, refused, fully refunded or returned, Cochetica may cancel or withdraw the points earned for that order.

In the case of partial returns or partial refunds, points may be adjusted proportionally according to the value of the products returned or refunded.

If points have already been used before an order is cancelled, refused, refunded or returned, Cochetica may adjust the customer’s points balance, Royalty benefits or account status, to the extent permitted by the technical settings of the loyalty platform.

5. Using Points

Points can be used exclusively on cochetica.com, in the form of site credit or discount for future orders.

The standard conversion is:

100 points = RON 1 site credit

To use points, the customer must have at least 2,000 points available in their account.

Points cannot be exchanged for cash, transferred to a bank account, withdrawn, sold or used outside cochetica.com.

Points may be used together with other discounts only to the extent allowed by the checkout settings and the rules of any active campaigns.

6. VIP Levels

Cochetica Royalty levels are determined based on the total points earned by the customer within the programme, including points earned from orders and, where applicable, bonus points granted through other actions or benefits.

The Royalty levels are:

- Bronze: from 0 to 2,500 total points earned.

- Silver: from 2,500 to 12,500 total points earned.

- Gold: over 12,500 total points earned.

Once a VIP level is reached, it remains permanently associated with the customer’s account, except in cases of fraud, abuse, technical error, account cancellation, or modification, suspension or termination of the programme.

7. Silver and Gold Benefits

Silver

Silver customers receive:

- 6 points for every eligible RON 1 spent;

- free shipping on eligible orders over RON 150;

- 1,500 birthday bonus points.

Gold

Gold customers receive:

- 7 points for every eligible RON 1 spent;

- free shipping on eligible orders over RON 100;

- 5,000 birthday bonus points.

Free shipping benefits apply only to eligible orders and only where the minimum order thresholds are met.

The availability of free shipping benefits may depend on the technical settings of the Store, the delivery country, the shipping area and the shipping methods available at checkout.

8. Birthday Bonus Points

Birthday bonus points are available only to customers in the Silver and Gold levels.

To receive birthday bonus points, the customer must have an active account created before the birthday date and must correctly add their date of birth to the account before the birthday date.

Birthday bonus points are granted once per year.

Cochetica is not responsible for failure to grant birthday bonus points if the date of birth is missing, incorrect, added too late, changed abusively or otherwise not available according to the technical settings of the loyalty platform.

9. Points Expiry

Points expire if the customer does not place any order on the website for 12 consecutive months.

When points expire, the available points balance may be reset to zero.

The expiry applies to the available points balance in the account, not individually to each point earned.

Cochetica may send reminder notifications before points expire, depending on the technical settings of the loyalty platform and the customer’s consent for commercial communications.

10. Changes, Suspension or Termination of the Programme

Cochetica reserves the right to modify the rules, benefits, thresholds, points value, eligibility conditions, expiry period or any other element of the Cochetica Royalty programme.

Cochetica may suspend or terminate the programme, with customer notification where required by applicable law and to the extent reasonably possible.

Any changes will apply from the date they are published on the website or from a later date expressly indicated.

11. Fraud, Abuse and Misuse

Cochetica may cancel points, benefits, VIP levels or accounts that have been obtained or used through fraud, abuse, fake orders, abusive returns, multiple accounts, attempts to manipulate the system or any behaviour that is contrary to the purpose of the programme.

Cochetica may review order history and points activity where there are reasonable indications of improper use of the programme.

12. Limitations and Clarifications

The Cochetica Royalty programme is not a financial product, bank account, electronic money service or cash-equivalent claim.

Points are a commercial benefit offered by Cochetica and can only be used under the conditions of this programme.

Points have no cash value and do not create any right to receive money.

In the event of differences between information displayed in the customer account and the actual technical settings of the loyalty platform, Cochetica will make reasonable efforts to correct any errors.

13. Personal Data

For the operation of the Cochetica Royalty programme, Cochetica may process personal data such as:

- customer name;

- email address;

- order history;

- points balance;

- VIP level;

- date of birth, where provided by the customer.

Personal data is processed in accordance with the Privacy Policy available on the website.

Customers can consult the Privacy Policy for more information about their rights and how their data is used.
